1. ABOUT THESE TERMS
These terms and conditions govern all services provided by H & H Landscapes ("we," "us," "our") to our clients ("you," "your"). By engaging our services, you agree to be bound by these terms.

2. SERVICE DEFINITIONS
Garden Maintenance Services
Garden maintenance refers to ongoing, regular care and upkeep of existing gardens and landscapes.
This includes but is not limited to:
- Lawn care and mowing
- Pruning of trees, shrubs, and plants
- Weeding and border maintenance
- Hedge cutting and trimming
- Seasonal planting and replanting
- Mulching and soil care
- General garden tidiness and waste removal
- Plant care advice and seasonal reminders
Green Waste Removal: All garden maintenance services include the collection and disposal of green waste only generated during our maintenance work. Green waste includes grass cuttings, pruned branches, leaves, weeds, dead plants, and other organic garden material. Green waste removal does NOT include rubble, soil, hardcore, building materials, or any non-organic waste - the disposal of such materials falls under landscaping project services and will be quoted separately.
Garden maintenance is typically scheduled on a regular basis (weekly, fortnightly, or monthly) and charged at our hourly rate of £25 per person + VAT.
Landscaping Projects
Landscaping projects refer to design, installation, and transformation work that creates new garden features or substantially alters existing landscapes.
This includes but is not limited to:
- Complete garden design and planning
- Hard landscaping (patios, paths, retaining walls, water features)
- Soft landscaping (new planting schemes, lawn installation)
- Garden makeovers and renovations
- Installation of new garden structures and features
- Soil preparation and ground works
- Drainage and irrigation systems
- Post-installation patio cleaning and garden maintenance
- Disposal of rubble, soil, hardcore, and building materials
Landscaping projects are quoted individually based on scope and materials, typically ranging from £5,000-£15,000, and require a 50% deposit before commencement.
3. SERVICES PROVIDED
We offer three main categories of services:
- Garden Maintenance: As defined in Section 2 above
- Landscape Design: Professional garden planning and design consultation
- Landscape Installation: Complete implementation of landscape projects as defined in Section 2 above
4. PRICING AND PAYMENT TERMS
Maintenance Services:
- Charged at £25 per hour, per person + VAT
- No seasonal packages or service bundles offered
- Invoices issued monthly for ongoing maintenance contracts
Design and Installation Projects:
- Project quotes provided following initial consultation
- Typical project range: £5,000 - £15,000
- 50% deposit required before work commences
- Final payment due within 14 days of project completion
Payment Terms:
- All invoices payable within 30 days of issue date
- Late payment charges of 1.5% per month may apply to overdue accounts
- We reserve the right to suspend services for accounts over 60 days overdue
5. ABORTED VISIT CHARGES
Garden Maintenance Services: If our maintenance team arrives at your property for a scheduled visit and is unable to complete the work due to circumstances beyond our control (including but not limited to: locked gates without access provided, unsafe site conditions, client unavailability when access is required, or work areas not cleared as requested), a charge of 25% of the scheduled maintenance invoice will be applied to cover travel time, scheduling disruption, and administrative costs.
This charge will be added to your next monthly invoice. To avoid aborted visit charges, please ensure:
- All access arrangements are in place
- Work areas are cleared of personal items
- Any site-specific requirements communicated in advance are met
- You are available if access or consultation is required
6. SCHEDULING AND ACCESS
Regular Maintenance:
- We will agree on a regular schedule for ongoing maintenance services
- 24 hours' notice required for any schedule changes
- Emergency/urgent maintenance requests responded to within 24 hours
Property Access:
- You must provide safe and reasonable access to all work areas
- We require access to water supply and electrical outlets where necessary
- Any locked gates or restricted areas must be clearly communicated in advance
7. WEATHER AND SEASONAL CONSIDERATIONS
- Services may be delayed or rescheduled due to adverse weather conditions
- We operate year-round but may adjust schedules during extreme weather
- No charges apply for weather-related delays or rescheduling
8. CLIENT RESPONSIBILITIES
- Ensure all work areas are clear of personal items and obstacles
- Inform us of any underground utilities, irrigation systems, or hidden hazards
- Provide accurate property boundaries and any relevant planning restrictions
- Ensure pets are secured during service visits
9. HEALTH AND SAFETY
- All our staff hold relevant City and Guilds qualifications in horticulture and landscaping
- We maintain comprehensive public liability insurance
- You are responsible for informing us of any site-specific safety concerns
- We reserve the right to refuse work in unsafe conditions
10. MATERIALS AND PLANTS
- We specialize in native plants and natural stone suited to the Hampshire climate
- All materials are sourced from reputable suppliers
- Plant warranties: 12 months from installation (subject to proper care and maintenance)
- Material defects will be replaced at no charge during the warranty period
11. VARIATIONS AND CHANGES
- Any changes to agreed work scope must be confirmed in writing
- Additional work will be charged at standard hourly rates
- We will provide estimates for significant variations before proceeding
12. CANCELLATION POLICY
Maintenance Services:​​
- Either party may terminate ongoing maintenance contracts with 30 days' written notice
- No cancellation fees apply for regular maintenance services
Project Work:
- Projects may be cancelled up to 48 hours before commencement with 50% deposit refund
- Cancellations after work has begun will be charged for completed work plus materials ordered
13. LIMITATION OF LIABILITY
- Our liability is limited to the value of services provided
- We are not liable for damage to existing plants, structures, or utilities not properly marked
- Claims must be reported within 7 days of service completion
- We maintain public liability insurance coverage
14. QUALITY GUARANTEE
- We guarantee our workmanship for 12 months from completion
- Any defects in workmanship will be remedied at no additional cost
- This guarantee does not cover normal wear, weather damage, or lack of maintenance
15. DATA PROTECTION
- We process personal data in accordance with UK GDPR requirements
- Client information is kept confidential and used solely for service delivery
- We may use project photos for marketing purposes unless you opt out
16. DISPUTE RESOLUTION
- We aim to resolve any concerns through direct communication
- Formal complaints should be submitted in writing within 30 days
- Unresolved disputes may be referred to mediation or small claims court
17. GENERAL TERMS
- These terms may be updated periodically with 30 days' notice
- If any provision is found unenforceable, the remainder remains in effect
- These terms are governed by English law
- Any modifications must be agreed in writing
